Recusación contra magistrado.
El memorialista presentó recusación contra el Magistrado Luis Ernesto Vargas Silva por cuanto una de sus declaraciones en un foro público reciente habría evidenciado que tiene interés en la decisión sobre la acción pública que provocó el presente proceso.
La Sala Plena juzga que no es pertinente la recusación promovida porque no se acreditó una afectación real de la capacidad subjetiva del magistrado para decidir de manera imparcial.
